Estimada Embajadora Barco,

Mi nombre es Yolanda de Zakzuk, la viuda de Julio Zakzuk Villadiego, ciudadana de los Estados Unidos, al igual que mis hijos, y accionistas mayoritarios de Maritimas Internacionales Limitada. Maritimas, nuestra compañía, fue una empresa fundada en la década de los sesenta en Cartagena. En 1982, fuimos debidamente contratados para transportar 1,100 toneladas desde el Puerto de Tampa hasta Barranquilla, Colombia, por el Agente legalmente autorizado por la institución estatal bancaria Caja Agraria mediante contrato de suministro de fecha Abril 26, 1982: Distribuidora Petrofert Limitada. Nosotros cumplimos al enviar nuestro barco, la moto nave Don Julio, desde Honduras hasta Tampa, cargamos su material, lo transportamos a Barranquilla y nunca fueron pagados nuestros servicios. Inclusive, cuando intentamos obtener justicia en las cortes, las cortes mismas han terminado como cómplices de estos funcionarios corruptos del Gobierno Colombiano. Han sido 25 años y ni siquiera hemos obtenido una decisión de segunda instancia ni mucho menos obtenido medida alguna de justicia.
Documentamos todo el episodio, paso por paso, y demandamos en el Juzgado Octavo Civil de Bogota, Colombia, en 1983 después de multitud de daños, debidamente documentados en el proceso judicial, causados por los actos de altos funcionarios gubernamentales oficiales en la Caja Agraria, como el Director General de la Caja Agraria Mariano Ospina Hernández:

Es del dominio publico, a través de multitud de investigaciones involucrando la Caja Agraria, y otras entidades bancarias oficiales, que esta clase de designación política presidencial era uno de las tradicionales conductos por los cuales se cometieron millares de episodios de peculado contra el tesoro publico Colombiano, la mayoría de ellos dirigidos por los mas altos ejecutivos en la entidad, antes de finalmente colapsar en 1999. Todos los gobiernos, desde la década de los ochenta, ignoro los escándalos, o activamente los encubría, y todo ministro de gobierno que intentaba corregir el foco de corrupción que era la Caja Agraria, era crucificado por el Gobierno Colombiano.

Después de iniciar procedimientos legales porque su cheque gubernamental salió sin fondos en su propia institución bancaria nacional,

el Señor Ospina trato de meter preso a mi esposo al acusarlo, falsamente, de tratar de obtener doble pago, usando el sistema judicial Colombiano para aterrorizar a nuestra familia con la posibilidad de que se llevara, en cadenas, a mi esposo a Bogotá. Un juez Colombiano voló a Barranquilla le pidió a mi esposo que se removiera su inmunidad diplomática, a la cual tenía derecho como Cónsul de Dinamarca por 25 años, y procedió a someterlo a interrogatorio. El juez termino disculpándose después de revisar la evidencia del fraude cometido contra nuestra empresa y contra el Tesoro Colombiano por este funcionario gubernamental. El juez también pidió que no se descargara el buque para que procediera una investigación pero esto también fue sepultado por las ineficaces y corruptas cortes Colombianas. Inclusive, el Señor Ospina nunca fue encausado; solamente el autor material, Heiner Jansen y su compañía Distribuidora Petrofert Limitada, fueron procesados por el fraude.

También es importante notar que la Caja Agraria, como institución gubernamental bancaria, tenía que tener conocimiento de legislación Colombiana y reglamento bancario sobre control de cambio, en efecto en aquel entonces, el cual hacia ilegal pagar a una naviera Colombiana en dólares Norteamericanos y, en cambio, ordenaba que el pago se hiciera en pesos Colombianos, así como nuestro contrato requería.

Inclusive, esta era la manera tradicional en que la Caja Agraria le pagaba a los armadores Colombianos: en el puerto a través de su Agente, Almagrario S.A.; el mismo que nos dio un cheque sin fondo. La manera como en esta transacción enviaron los fletes del armador en dólares y después contratarnos a nosotros para pagarnos en pesos, como la ley requería, todo con el conocimiento de la Caja Agraria, era ilegal probando así el carácter delictivo y la mala fe con la cual los funcionarios gubernamentales estaban procediendo pues ellos tenían conocimiento de que un contrato fraudulento estaba siendo firmado. No solamente esto, sino que ellos, los funcionarios y agentes de la Caja Agraria también tenían conocimiento de que el contrato nuestro era con el flete POR COBRAR, CUANDO LA CAJA AGRARIA MISMA YA LE HABIA DADO NUESTRO FLETE A AMAX CHEMICAL, el fabricante del producto que la Caja Agraria estaba comprando. Ejerceremos nuestro derecho de petición, consagrado en la Primera Enmienda de la Constitución, a nuestros líderes electos en el Congreso de los Estados Unidos para que protejan nuestros derechos contra el abuso de su Gobierno por mas de 25 años y estaremos presentándoles toda la documentación, adjunta a nuestro pedido que su Gobierno llene las expectativas de conducir sus actos dentro de el estado de derecho antes de que se apruebe alguna alianza comercial. La Póliza de Fletamento que nuestra compañía usaba estaba basada en el estándar GENCON (Condiciones Generales) creado en 1922 por la organización que ha creado estos estándares, BIMCO, fundada en Copenhague, Dinamarca, en 1905, e incluida en la Clausula XXV se encontraba la USA CLAUSE PARAMOUNT la cual hace este contrato valido y sujeto a la jurisdicción del Congreso de los Estados Unidos bajo la Ley sobre el Transporte de Bienes por Mar de 1936.

Esto significa que al cometer fraude en jurisdicción Norteamericana, el Gobierno de Colombia no solo ha abusado de la propiedad de ciudadanos Norteamericanos sino que ha violado las leyes del Congreso Norteamericano el mismo que ahora le pide que lo reciba como socio comercial legitimo y honorable.


La Ley de Transporte de Bienes por Mar de 1936 también declara, en parte:

§ 1304 Derechos e Inmunidades del armador y el barco

Ni el armador ni el barco serán responsables por perdida o daño que provenga de o resulte de—

i. Acto u omisión del que envía la carga o el dueño de la carga, su agente o representante

Mas claramente correctos en nuestra posición no podemos estar.

Clamamos por un fin a este sórdido capitulo de obvio nepotismo y corrupción en la historia del Gobierno Colombiano, pues fue su Gobierno el ofensor y continua siéndolo hasta el día de hoy a través de su corrupto sistema legal. Nos tomo 13 años para obtener una decisión del juez de nuestro caso, a solamente la primera instancia, lo cual de por si es evidencia de fraude judicial, y de acuerdo con este juez octavo civil del circuito de Bogota, el Señor Jorge H. Navarro Plazas, nosotros, las victimas del crimen, teníamos que probar la conducta delictiva de la Caja Agraria; esto es incorrecto, la Caja Agraria era directamente responsable, como el Principal, por los actos de su Agente, o mejor dicho el cómplice de el Señor Ospina, Heiner Jansen y su compañía Petrofert, incluyendo cualquier contrato firmado por el Agente necesario para cumplir con sus obligaciones con el Principal. Esto es un principio básico de la jurisprudencia del derecho comercial definido como la relación Principal y Agente, sus obligaciones, derechos y responsabilidades civiles con daños a Terceras Personas inocentes que dependen de las aseveraciones hechas por el Agente y que cuentan con la implícita y tacita autorización del Agente para actuar en nombre del Principal. Además, si era de alguien la responsabilidad de probar el fraude era del Gobierno Colombiano pero no estaba a punto de investigar al hijo de un ex Presidente de Colombia, como es obvio, pues la evidencia ha reposado en las cortes Colombianas por más de 25 años. En un momento la Caja Agraria hasta llego a alegar que la carga no era suya y después en otra instancia judicial acepta ser el dueño de la carga:

Como podrán darse cuenta en los hipervínculos, los términos de demurrage, principio legal milenario del derecho marítimo sobre demoras incurridas, fueron estipulados a la rata de US $1.000,00 diarios; el buque estuvo inmovilizado por 156 días. El flete era de US $32,00 por tonelada métrica y nosotros cargamos 1,100 toneladas +-5%, pagaderos en pesos con Cheque de Gerencia antes de descargar el buque, o F.I.O.S.T (Libre de gastos de cargue, descargue, estiba y trimado). La tasa de interés estipulada por demoras en cancelar la Factura Comercial era de 0.9% diario. Eso es correcto, 0.9% diario, lo cual hace a su Gobierno legalmente obligado a pagar a Maritimas una cifra que contiene 40 dígitos a través de 25 años de impunidad. Nosotros aceptamos que esta figura no es realística y estamos dispuestos a aceptar una tasa muy cercana al margen de ganancia histórico de Maritimas. Esto es la única resolución justa que estamos dispuestos a aceptar.

Este próximo hipervínculo es, nuevamente, el documento escrito por mi esposo en 1986, después de haber presentado otra cuenta el 5 de Noviembre de 1984 por US $717.894,00, pidiéndole al Sr. Ospina Hernández autorización para cobrarle a Amax Chemical el flete nuestro entregado a ellos por la Caja Agraria misma. El, claro, se negó pues esto hubiera podido significar una investigación fuera de su alcance para manipular.

O SEA QUE NO SOLAMENTE NO NOS PAGARON SINO QUE TAMPOCO NOS PERMITEN COBRARLE A LA GENTE QUE LE DIERON NUESTRO FLETE
. ¿Que mas evidencias se necesitan para probar la conducta criminal del Sr. Ospina? ¿Si ellos mismos alegan que le dieron nuestro flete a Amax Chemical entonces porque no autorizar el cobro nuestro en Estados Unidos? ¿Si ese dinero ellos mismos estipulan que era para los fletes y nosotros le trajimos la carga porque nos vuelven a negar el fruto de nuestro trabajo? También es importante notar que la documentación que acompañaba el fertilizante comprado por la Caja Agraria especificaba que era de una calidad de mayor precio a el que de veras era, debido a su composición química; descubrimos este hecho después de obtener permiso del Juzgado Séptimo de Barranquilla para descargar el buque, a cuenta nuestra, y preparar la carga para el martillo del Banco Popular. El sistema judicial Colombiano también ha tenido esta otra prueba más de la corrupción y se ha hecho, voluntariamente, el de la vista gorda por 25 años. Lo que no estamos dispuestos a aceptar es que nuestro reclamo por justicia continúe siendo burlado ni un segundo más. El Estado Colombiano debe cancelar esta deuda a la mayor brevedad.
El caso ahora reposa en los archivos del Magistrado Darío Estrada Sanín en el Tribunal Superior de Antioquia con número de radicación 0042. Nosotros también quisiéramos notar que no se nos ha escapado el hecho de que Medellín, donde nuestro caso ahora reposa, es el bastión político tradicional de la familia Ospina.
Si su Gobierno ignorara nuestro reclamo de acabar con esto, aquí y ahora, en Washington, ante nuestros lideres electos, entonces esfuerzos por obtener publicidad para la conducta corrupta de su Gobierno comenzaran.

Dear Ambassador Barco,


My name is Yolanda de Zakzuk, Julio Zakzuk’s widow, a citizen of the United States, along with my children, and majority stockholder for Maritimas Internacionales Limitada. Maritimas, our company, was an enterprise founded by my husband in Cartagena in the 1960’s. In 1982, we were ostensibly hired to transport 1,100 tons from the US port of Tampa, to Barranquilla, Colombia, by the Colombian governmental banking institution Caja Agraria, Industrial y Minero's legally authorized Agent. We complied by sending our ship, the motor vessel Don Julio, from Honduras to Tampa, loaded your cargo, transported it to Barranquilla and were never paid for our work. Indeed, when we attempted to obtain justice in the courts, the courts have ended up being accomplices of these same corrupt Colombian government officials. It has been 25 years and we have not even reached an appellate level decision, much less obtained any measure of justice.

We documented the episode, step by step, and sued in Juzgado 8 Civil, in Bogota, Colombia, in 1983 after suffering multitude of damages by the acts of highly placed Colombian government officials in the Caja Agraria, such as Director General of the Caja Agraria Mariano Ospina Hernandez:

It is widely known, through a multitude of investigations into the Caja Agraria, and other state banking institutions, that this kind of presidential political appointment was one of the traditional gateways to thousands of episodes of massive fraud against the Colombian public treasury, the majority of them masterminded by the highest executives in the entity, before finally imploding in 1999. Every government since the 1980’s ignored the scandals, or actively covered them up, and every government minister who tried to deal with the Caja Agraria corruption problem was crucified by the Colombian government.

Mr. Ospina tried to have my husband imprisoned by falsely accusing him of trying to obtain payment twice, using Colombia's judicial system to terrorize our family with the possibility of taking my husband to Bogotá in chains. A Colombian judge flew to Barranquilla, from Bogotá, asked my husband to relinquish the diplomatic immunity he was entitled to as Consul of Denmark for 25 years, and proceeded to submit my husband to interrogatory. The judge ended up excusing himself after seeing the evidence of the fraud committed against our enterprise and against the Colombian treasury by this government official. He also requested that the ship not be unloaded so that an investigation may proceed but that was also buried by the ineffective and corrupt Colombian courts. Indeed, Mr. Ospina was never prosecuted; only his bag man, Heiner Jansen, and his company Petrofert, were prosecuted for the fraud.

It is also noteworthy that the Caja Agraria, as a governmental banking institution, had to be aware of Colombian legislation and regulation in reference to currency controls, in effect at the time, which made it illegal to pay a Colombian ship-owner in US dollars and instead mandated, as our contract required, that payment be made in Colombian pesos.

Indeed, this was the traditional way the Caja Agraria paid Colombian ship owners: at the port through its agent Almagrario S.A.; the same one who issued the check that bounced. The sending of the freight charges included in the Letter of Credit payable to a foreign manufacturer and then hiring us was illegal proving the malfeasance and bad faith with which Colombian government officials at the Caja Agraria were proceeding because they were aware of our contract from the moment it was signed. Not only this, but they also knew the contract stipulated Freight Collect when they had already given our payment to Amax Chemical, the manufacturer of the product the Caja Agraria was buying.

We will petition our elected officials in Congress to protect our rights against your government’s 25 year long abuse and will be providing all documentation, along with our request that your government live up to the expectation of conducting government behavior according to the rule of law before any trade alliance is granted. The Charter Party Agreement our company used was based on the GENCON (general conditions) standard created by the maritime trade standard setting body BIMCO, founded in Copenhagen, Denmark in 1905, and included in Clause XXV was the USA Clause Paramount which made this contract valid and subject to the jurisdiction of the Congress under the Carriage of Goods by Sea Act of 1936.

This means that by committing fraud in American jurisdiction the Colombian government not only has abused United States citizens’ property but also broken the laws of the Congress of the United States.

The Carriage of Goods by Sea Act of Congress also reads, in part:

§ 1304. Rights and immunities of carrier and ship

Neither the carrier nor the ship shall be responsible for loss or damage arising or resulting from--

  1. Act or omission of the shipper or owner of the goods, his agent or representative



We demand closure for this sordid chapter of blatant nepotism and corruption in the Colombian government’s history, for it was your government which was the offender and continues to be to this day through its corrupt legal system. It took 13 years, which in itself is proof of judicial fraud, to obtain a judge‘s decision on our case, at only the first instance level, and according to this judge, we, the victim of their crime, have to prove the malfeasance by the Caja Agraria; that is incorrect, the Caja Agraria was directly responsible, as the Principal, for its Agent’s, or better put Mr. Ospina’s bag man, Heiner Jansen and his company Petrofert Limitada’s, actions including any contracts entered into by it in fulfillment of its obligations to the Principal. This is a basic principle of commercial law jurisprudence found under the Principal Agent legal relationship. Besides, if it was anybody’s job to prove the fraud it was the Colombian government, except, of course it wasn’t about to investigate a son of an ex-president of Colombia, because the evidence has been sitting in their courts for 25 years.

We believe that it was Clause XXIII which created the other large impasse to obtaining some measure of justice:

As you can see in the links above, the terms of demurrage were stipulated at the rate of US $1,000.00 per day; the ship was immobilized for 156 days. The rate for transport was US $32.00 per metric ton and we carried 1,100 tons +-5%, payable in pesos before unloading the ship, or F.I.O.S.T. The interest rate for any delays in paying the Commercial Invoice was 0.9% compounded daily. That’s correct, compounded daily, which makes your government legally liable to Maritimas Internacionales Limitada a number which has grown to 40 digits through 25 years of impunity. We acknowledge that this figure is not realistic and are willing to accept a rate which closely resembles Maritimas’ historic profit margin. This is the only fair outcome we will accept.

This next link is a document my husband wrote in 1986, after presenting another bill in 1984 for US $750,000, asking Mariano Ospina Hernandez for authorization to collect from Amax Chemical our freight charges, which he himself had authorized being given to the foreign manufacturer who was the beneficiary of Letter of Credit #5276. He, of course, ignored our request as this might have meant an international investigation outside of his manipulation.

It is also worth noting that the documentation for the fertilizer bought by Caja Agaria specified that the material was to be of a more expensive quality than the one actually sent, we discovered this fact after obtaining the Seventh Civil Court of Barranquilla's permission to unload the ship, at our expense, and auction the cargo off. This was the other way Mr. Ospina was profiting from the scheme. The Colombian judicial system is privy to this further evidence of corruption and yet it has willingly turned a blind eye for 25 years.

What we are not willing to accept is our claim for justice to continue being made a mockery of for another second. The Colombian government must pay its bill now.

The case is now sitting in Magistrate Dario Estrada Sanin’s archives at the Tribunal Superior de Antioquia with Case #0042. We would also like to point out that it has not escaped our attention that Medellin, where our case sits, is the traditional political bastion of the Ospina family.

Should your government prove unresponsive to our request to settle this, here and now, in Washington, before our elected officials, then efforts to publicize your government’s corrupt behavior will commence and this will end with a hunger strike in front of your embassy in Washington and in the Congress of the United States by the widow, the children and grandchildren of your victim which are all United States citizens.
